Cosmic Drop Terms of Use

Introduction

These Terms of Use ("Terms") govern your use of Cosmic Drop ("Cosmic Drop", "the App", "we", "us", or "our"), operated by LEGAL_NAME.

By downloading, accessing, or using Cosmic Drop, you agree to these Terms. If you do not agree to these Terms, please do not use the App.

1. The Game

Cosmic Drop is a casual puzzle game in which players drop and merge cosmic pieces, earn scores and virtual rewards, use power-ups, and attempt to achieve higher scores.

Features may include:

• drop-and-merge puzzle gameplay;
• scores and high scores;
• coins and gems;
• power-ups;
• combos and progression rewards;
• rewarded advertisements;
• interstitial advertisements;
• in-app purchases; and
• optional premium entitlements such as Cosmic Pass.

Features, balancing, rewards, and game systems may change through future updates.

2. Eligibility

You must meet the minimum age and legal requirements applicable in your country and under the rules of the platform through which you downloaded Cosmic Drop.

If you are below the age at which you may independently agree to these Terms, a parent or legal guardian should review and agree to these Terms where required by applicable law.

3. License to Use Cosmic Drop

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Cosmic Drop for personal, non-commercial entertainment purposes.

You do not acquire ownership of the App, its source code, artwork, game systems, virtual currency, branding, music, sound effects, or other intellectual property.

4. App Store Terms

If you download Cosmic Drop through the Apple App Store, your use of the App is also subject to Apple's applicable terms, policies, and conditions.

Purchases, refunds, and certain platform services are handled by Apple according to Apple's applicable terms and policies.

5. Gameplay

Cosmic Drop is provided for entertainment purposes.

Gameplay systems including rules, scores, combinations, probabilities, rewards, power-ups, difficulty, progression, and balancing may be modified over time as the game evolves.

We do not guarantee:

• a particular score or high score;
• a particular game outcome;
• a specific piece appearing at a specific time;
• a particular reward;
• continued availability of a specific power-up; or
• continued availability of any particular gameplay feature.

6. Virtual Currency and Virtual Items

Cosmic Drop may contain virtual items and virtual currencies, including:

• coins;
• gems;
• power-ups;
• bonuses;
• rewards; and
• other in-game resources.

Virtual items:

• exist only within Cosmic Drop;
• have no real-world cash value;
• cannot be exchanged for cash;
• cannot be transferred to another user unless we explicitly provide such functionality;
• do not constitute money, bank funds, cryptocurrency, securities, or stored monetary value.

We may adjust the availability, balance, cost, rewards, functionality, or value of virtual items where reasonably necessary for gameplay, technical, security, or balancing reasons.

Nothing in this section limits rights that cannot legally be excluded under applicable consumer protection law.

7. In-App Purchases

Cosmic Drop may offer optional paid digital content through the Apple App Store or other supported app stores.

Current purchases may include:

• 10 Gems;
• 35 Gems;
• 80 Gems; and
• Cosmic Pass.

Prices are displayed by the applicable app store and may vary by country, currency, taxes, and store pricing rules.

Payments are processed by the relevant app store. We do not directly process or store your complete payment card details.

8. Consumable Purchases

Gem packs are consumable purchases.

Once successfully delivered, consumable virtual currency may be spent within Cosmic Drop.

Consumable purchases generally cannot be restored through Apple's standard Restore Purchases functionality after they have been consumed.

Because Cosmic Drop currently stores much of its gameplay state locally, deleting the App, clearing application data, changing devices, or losing access to your device may result in the loss of consumable balances where no cloud synchronization system is available.

9. Cosmic Pass

Cosmic Pass is a non-consumable in-app purchase.

When active, Cosmic Pass removes forced interstitial advertisements from Cosmic Drop.

Cosmic Pass does not necessarily remove optional rewarded advertisements.

Rewarded advertisements may remain available because they are voluntarily initiated by the player in exchange for optional in-game rewards.

Eligible Cosmic Pass purchases may be restored using the App's Restore Purchases functionality and Apple's applicable purchase restoration mechanisms.

10. Purchase Verification

Cosmic Drop may verify in-app purchases in order to confirm valid transactions, prevent duplicate fulfillment, restore eligible entitlements, and reduce fraud.

Purchase verification may involve Apple's StoreKit infrastructure and a purchase verification service such as IAPKit.

We may reject or delay fulfillment where a purchase cannot be successfully verified.

11. Refunds

Purchases made through the Apple App Store are billed and administered by Apple.

Refund eligibility and refund requests are generally handled through Apple's applicable policies and procedures.

Nothing in these Terms limits refund rights or statutory consumer rights provided by applicable law.

12. Advertising

Cosmic Drop may display advertisements using services such as Google AdMob.

Advertising may include:

Rewarded advertisements. You voluntarily choose to watch an advertisement in exchange for an indicated in-game reward.

Interstitial advertisements. Advertisements that may appear between completed game sessions or at other appropriate non-gameplay moments.

Advertising is not intended to interrupt active gameplay.

We may change advertising frequency, placement, availability, or providers over time.

13. Rewarded Advertisement Rewards

Rewards associated with rewarded advertisements are granted only after the advertising provider confirms that the required rewarded-ad event has occurred.

Closing an advertisement early, losing connectivity, encountering a technical failure, or failing to receive confirmation from the advertising provider may result in the reward not being granted.

We may use reasonable technical measures to prevent duplicate, manipulated, or fraudulent reward claims.

14. No Guarantee of Ad Availability

We do not guarantee that advertisements will always be available.

Ad availability may depend on factors outside our control, including:

• your location;
• network connectivity;
• advertising inventory;
• consent choices;
• device settings;
• third-party service availability; and
• advertising provider policies.

If a rewarded advertisement is unavailable, the associated optional reward may also be temporarily unavailable.

15. Prohibited Conduct

You may not:

• exploit bugs to obtain unauthorized rewards;
• manipulate scores, coins, gems, or game state;
• falsify purchase transactions;
• attempt to obtain duplicate purchase rewards;
• tamper with purchase verification systems;
• circumvent advertisements using unauthorized technical methods;
• modify or tamper with the App;
• reverse engineer, decompile, or disassemble the App except where applicable law expressly permits it;
• distribute modified copies of Cosmic Drop;
• use bots, cheats, scripts, automation, or similar mechanisms to manipulate gameplay;
• interfere with security systems;
• attempt unauthorized access to our systems or services;
• use Cosmic Drop for unlawful purposes; or
• infringe our intellectual property rights or the rights of others.

We may take reasonable measures to prevent, investigate, or respond to fraud, cheating, abuse, or security threats.

16. Intellectual Property

Cosmic Drop and its associated content, including without limitation:

• the Cosmic Drop name;
• logos and branding;
• graphics and artwork;
• cosmic game pieces;
• animations;
• sound effects;
• music;
• user-interface designs;
• software and source code;
• written content; and
• game systems and mechanics to the extent protected by applicable law;

are owned by us or licensed to us and are protected by applicable intellectual property laws.

No rights are granted except for the limited license expressly provided by these Terms.

17. Third-Party Services

Cosmic Drop relies on third-party services that may include:

• Apple and the Apple App Store;
• Apple StoreKit;
• Google AdMob;
• Google consent services;
• IAPKit or another purchase verification provider; and
• other technical service providers.

These services may be outside our direct control and may be governed by their own terms, policies, and privacy practices.

18. Internet Access

Some Cosmic Drop features require an internet connection, including potentially:

• advertisements;
• purchase verification;
• purchase restoration;
• App Store services; and
• other third-party functionality.

Your mobile carrier or internet provider may charge you for data usage.

We are not responsible for internet, mobile-data, roaming, or similar connectivity charges.

19. Local Game Data

Cosmic Drop currently stores much of its gameplay progress and settings locally on your device.

This may include:

• high scores;
• coin and gem balances;
• selected power-ups;
• game settings;
• reward state; and
• other gameplay progress.

We do not guarantee that locally stored data can be recovered after uninstalling the App, clearing its data, device failure, or device loss.

Non-consumable App Store entitlements such as Cosmic Pass may be restorable separately through the relevant app-store mechanisms.

20. Updates

We may update Cosmic Drop to:

• add or remove features;
• adjust gameplay balancing;
• change rewards or power-ups;
• fix bugs;
• improve performance;
• address security issues;
• comply with legal requirements;
• comply with App Store requirements; or
• maintain compatibility with operating systems and third-party services.

Certain updates may be required for continued use of some or all features of Cosmic Drop.

21. Availability

We aim to keep Cosmic Drop available and functional, but we do not guarantee uninterrupted or permanent availability.

Cosmic Drop or individual features may temporarily become unavailable because of:

• maintenance;
• technical failures;
• network failures;
• third-party service outages;
• security issues;
• platform changes;
• legal requirements; or
• circumstances outside our reasonable control.

22. Suspension or Discontinuation

We may suspend, modify, or discontinue Cosmic Drop or individual features in the future.

If paid functionality is materially affected, applicable consumer protection laws and app-store requirements will continue to apply.

23. Disclaimer

To the extent permitted by applicable law, Cosmic Drop is provided on an "as is" and "as available" basis.

We do not guarantee that the App will always:

• operate without interruption;
• be completely error-free;
• be compatible with every device;
• preserve every locally stored game state;
• have advertisements available;
• have third-party services available; or
• operate without temporary service interruptions.

Nothing in these Terms excludes warranties, guarantees, or statutory rights that cannot lawfully be excluded.

24. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, consequential, or special losses arising solely from your use of or inability to use Cosmic Drop.

This limitation does not apply where liability cannot legally be excluded or limited, including where applicable for intentional misconduct, gross negligence, personal injury, or mandatory consumer rights.

25. Consumer Rights

If you are a consumer in Germany, the European Union, the European Economic Area, the United Kingdom, or another jurisdiction with mandatory consumer protection laws, you retain all rights granted to you by applicable law.

Nothing in these Terms is intended to waive, exclude, or restrict mandatory statutory consumer rights.

26. Children and Minors

Cosmic Drop is a general-audience puzzle game and does not involve real-money gambling.

Virtual coins, gems, and other in-game resources cannot be redeemed for real money.

If applicable law requires a parent or legal guardian to consent to a minor's use of the App or purchases, that consent should be obtained before using those features.

27. Privacy

Your use of Cosmic Drop is also subject to our Privacy Policy.

28. Changes to These Terms

We may update these Terms when Cosmic Drop changes, when new features are introduced, when monetization changes, or when legal or platform requirements change.

The updated Terms will display a revised "Last updated" date.

Where legally required, we will provide additional notice before material changes take effect.

29. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the maximum extent permitted by law.
