Cosmic Defence Terms of Use

1. Agreement to These Terms

These Terms of Use ("Terms") govern your use of Cosmic Defence. By downloading, installing, accessing, or playing Cosmic Defence, you agree to these Terms.

Cosmic Defence is published by Hamza Haddada Software.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Cosmic Defence for your own personal, non-commercial entertainment.

You do not acquire ownership of the App, its code, artwork, game systems, virtual items, or other intellectual property.

3. The Game

Cosmic Defence is a space-defense game featuring gameplay systems that may include:

• enemy waves;
• boss encounters;
• level-up abilities;
• permanent upgrades;
• tactical powers;
• Coins and Gems;
• daily rewards;
• advertisements; and
• optional in-app purchases.

Game mechanics, balancing, rewards, prices, cooldowns, difficulty, abilities, and other gameplay features may be changed through future updates.

4. Virtual Currency and Virtual Items

Cosmic Defence may include virtual currencies such as Coins and Gems and digital items such as upgrades and tactical powers.

Virtual items:

• are licensed, not sold;
• exist only within Cosmic Defence;
• have no monetary or cash value;
• cannot be exchanged for real-world currency; and
• cannot be transferred between users unless we explicitly introduce such functionality.

We may adjust game economies, rewards, upgrade costs, and virtual-item functionality where reasonably necessary for balancing, technical, or gameplay reasons.

5. In-App Purchases

Some digital content may be purchased using real money through the Apple App Store or Google Play. Examples may include gem packs and Remove Ads.

Prices shown in the App are provided by the applicable platform and may vary by country, currency, taxes, or storefront. Purchases are processed by Apple or Google and are subject to their respective payment terms.

Refund requests generally must be submitted through the platform that processed the purchase.

6. Consumable Purchases and Remove Ads

Gem packs are generally consumable purchases. Once properly delivered to your in-game balance, consumable virtual currency is normally not restorable as a reusable purchase through the standard Restore Purchases function.

Where offered, Remove Ads is intended to disable automatic advertisements such as interstitial ads. Optional rewarded advertisements may remain available because they provide voluntary in-game rewards.

The exact advertising experience may change as the App evolves.

7. Advertising

Cosmic Defence may contain advertising. Certain advertisements may offer optional in-game rewards in exchange for watching an advertisement.

You are never guaranteed that a rewarded advertisement will always be available, because availability depends on advertising providers, network connectivity, location, consent status, and other factors outside our control.

8. Local Progress and Restoring Purchases

The App may store game progress locally on your device. You are responsible for maintaining access to your device and any platform account associated with purchases.

Unless explicitly supported by a cloud-save feature, we cannot guarantee restoration of local game progress following app deletion, device loss, device replacement, storage corruption, or an operating-system reset.

Store-managed purchases such as Remove Ads may be restorable where supported by Apple or Google.

9. Prohibited Conduct

You must not:

• reverse engineer the App except where applicable law expressly allows it;
• modify or redistribute the App without permission;
• attempt to bypass purchase systems;
• manipulate advertising rewards fraudulently;
• exploit bugs to generate unauthorized virtual currency or purchases;
• use cheats, automation, modified clients, or other systems intended to interfere with normal gameplay; or
• attempt to interfere with the security or operation of the App.

We may take reasonable steps to protect the integrity of the game and its economy.

10. Intellectual Property

Cosmic Defence and its original content, including its source code, gameplay systems, branding, graphics, interface designs, characters, icons, and other original materials, are protected by applicable intellectual-property laws.

Some audio, software libraries, or other materials may be used under licenses provided by their respective owners. Those materials remain the property of their respective rights holders.

11. Third-Party Services

The App may depend on third-party platforms and services including Apple, Google, advertising providers, and software infrastructure providers.

We are not responsible for outages, policy changes, account restrictions, service interruptions, or other events caused by third-party services outside our reasonable control.

12. Updates and Availability

We may update Cosmic Defence to:

• add or remove features;
• fix bugs;
• improve security;
• rebalance gameplay;
• introduce new enemies or abilities;
• adjust tactical powers;
• change virtual economies; and
• maintain compatibility with operating systems or third-party services.

We cannot guarantee that every version or feature will remain available indefinitely.

We aim to keep Cosmic Defence available and functional, but uninterrupted or error-free access is not guaranteed. The App may occasionally be unavailable due to maintenance, technical problems, platform issues, or circumstances outside our control.

13. Disclaimer

Cosmic Defence is provided on an "as is" and "as available" basis to the extent permitted by applicable law.

We do not guarantee that:

• the App will always be uninterrupted;
• all features will always remain available;
• the App will be free of bugs; or
• saved progress can always be recovered.

Nothing in these Terms excludes rights that cannot legally be excluded under applicable consumer law.

14. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential losses arising from use of the App.

Nothing in these Terms limits liability where such limitation would be prohibited by applicable law, including mandatory consumer protections.

15. Ending or Discontinuing the App

You may stop using Cosmic Defence at any time by uninstalling the App. We may suspend or discontinue the App or particular services where reasonably necessary for technical, legal, security, or operational reasons.

16. Apple App Store Terms

If you downloaded Cosmic Defence through the Apple App Store, you acknowledge that these Terms are between you and the developer, not Apple.

Apple is not responsible for the App or its content except to the extent required under Apple's applicable terms. Where Apple's Standard End User License Agreement applies, it may supplement these Terms.

17. Changes to These Terms

We may update these Terms when the App, business model, services, or applicable law changes. Continued use of the App after updated Terms become effective constitutes acceptance where permitted by applicable law.

18. Governing Law

These Terms are governed by the laws of Germany, subject to any mandatory consumer-protection laws that apply in your country of residence.

Nothing in these Terms deprives consumers of protections they are entitled to under applicable law.
